1. Introduction

Welcome to Image to PSD. By accessing or using our AI image-to-PSD conversion service at imagetopsd.net ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Service.

2. Service Description

Image to PSD is an AI-powered platform that decomposes a source raster image (JPG, PNG, WEBP, GIF, or AVIF) into multiple RGBA layers and assembles them into a standard, layered Photoshop PSD file. The Service uses third-party AI models (currently fal-ai's Qwen-Image-Layered) to perform the layer decomposition and the open-source ag-psd library to write the final PSD container.

3. User Accounts and Registration

  1. Account Creation: To access the conversion features of the Service, you need to create an account. You may register using your email address or sign in through Google or GitHub.

  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Credits and Payment

  • Our Service operates on a credit-based system. Credits are consumed when converting an image to a layered PSD (1 credit per conversion).
  • The Free tier includes 3 conversions per month at no cost. Paid tiers (Pro and Lifetime) provide higher monthly or lifetime credit allowances.
  • All purchases of credits and subscriptions are final and non-refundable unless otherwise required by law.
  • Prices are subject to change with notice to users.
  • Payment is processed securely through Stripe, PayPal, or Creem. You agree to pay all charges associated with your selected plan.

5. Content and Intellectual Property Rights

All platform code, user interface, AI integration glue, and documentation provided through Image to PSD is protected under copyright law. The copyright owner of the Image to PSD platform is imagetopsd.net.

  • You acknowledge that you do not own the underlying technology or intellectual property that makes up the Image to PSD service, and you agree to respect the intellectual property rights of imagetopsd.net and any third parties (including the upstream AI providers).
  • You retain all rights to the images you upload and to the generated PSDs and layer outputs. We claim no ownership over your inputs or outputs and do not use them for any purpose other than fulfilling your conversion request.
  • You are responsible for ensuring you have the rights to upload and convert any image you submit. Do not upload images you do not have the right to use.

6. User Obligations

By using our Service, you agree to:

  • Use the Service in compliance with all applicable laws and regulations
  • Not attempt to circumvent any limitations or security measures (including rate limits, file-size caps, and credit allowances)
  • Not use the Service for any illegal or unauthorized purposes
  • Not interfere with or disrupt the Service or servers
  • Not use automated tools to abuse the Service or API beyond reasonable individual use

7. Content Guidelines

You agree not to upload or convert images that:

  • Violate any applicable laws or regulations
  • Contain hateful, discriminatory, or harassing material
  • Infringe on intellectual property rights you do not hold
  • Contain sexually explicit, pornographic, or child-exploitative material
  • Are intended to harass, defame, or harm an identifiable individual
  • Are deepfakes or manipulated images intended to deceive

We reserve the right to refuse processing of, and to delete, any content that we believe in good faith violates these guidelines.

8. Privacy and Data Protection

Our privacy practices are outlined in our Privacy Policy. In summary:

  • Your uploaded images and the AI-generated layers / PSD outputs are deleted from our storage within 24 hours of the conversion.
  • We never use your uploaded images, generated layers, or PSD outputs to train any AI model.
  • Image data is transmitted to the upstream AI provider (fal.ai) only for the duration of the conversion request and is subject to that provider's own data-handling policies.

9. Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. Conversion availability also depends on upstream AI providers, which are outside our control.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. The AI-generated layer decomposition is best-effort: layer accuracy, count, and grouping may vary by input image and are not guaranteed. We make no warranties about the precision or fitness for any particular purpose of the generated PSDs and disclaim all warranties to the fullest extent permitted by law. For professional or commercial use, we recommend manual review of the generated PSD before using it in production.

11. Limitation of Liability

To the fullest extent permitted by law, Image to PSD shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless Image to PSD, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms — including any claims arising from images you upload that you did not have the right to use.

13. Termination

We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms. We will notify users of material changes by posting the updated Terms on this page.
